Whistleblower channel

Law No. 93/2021, which establishes the general regime for the protection of whistleblowers of violations, transposing Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons reporting breaches of Union law, created the obligation to implement internal reporting channels and procedures to ensure compliance with the principles underlying this new legal framework.
For this purpose, PROF (Santos & Juniores, SA) provides this reporting channel, ensuring compliance with current legislation.
All information regarding the operation of this reporting channel is regulated in the following documents, which you should consult – without exempting you from reading Law No. 93/2021 – before filing any complaint:

INFORMATION ABOUT THE PROCESSING OF PERSONAL DATA

The entity Responsible for Processing your Personal Data is Santos & Juniores, SA, corporate number 503 548 910, with registered office at Rua Garrett, no. 44, 1200-204, Póvoa de Varzim.
In strict compliance with the legal obligations arising from Law No. 93/2021, of December 10 (General Regime for the Protection of Whistleblowers of Infractions) and Decree-Law No. 109-E/2021, of December 9 (General Regime for the Prevention of Corruption), we will process some of your personal data, namely, identification data and contact details, as well as any other information that you consider relevant to provide us, for the purposes of receiving and following up on the complaint/s that you submit. We will only retain your personal data for the legal period of 5 (five) years and, regardless of this period, during the pendency of judicial or administrative proceedings relating to the complaint/s.
Your personal data may be transmitted to third parties (Subcontractors) whose participation is essential to ensure the regular functioning of this channel or the adequate processing of complaints submitted. Whenever these third parties process your personal data, on our behalf and on our behalf, we guarantee the same level of security, confidentiality and privacy in said processing.
Santos & Juniores, SA, may have to transmit some of your personal data to the Competent Authorities, due to legal and/or judicial imposition.
As the holder of personal data, you may, at any time, exercise your rights in terms of data protection – right of access, right of rectification, right of erasure, right of limitation, right of portability and right of opposition – by sending a request to the following email address: administracao@prof.pt
