  • I - Identification

    The “Seller” PROF (Santos & Juniores, S.A.) offers products for sale on www.profonlinestore.com and its e-commerce business services are available exclusively to its end users, i.e. the "Consumers".

     

    PROF reserves the right not to process orders received from users who are not "Consumers" and any other order which does not comply with the Seller’s business policy.

     

      The "Consumer" should undertake to provide correct and accurate e-mail or postal address, or other contact details to the "Seller" and acknowledge that the "Seller" may use these details to contact him or her in the event that this should prove necessary.

  • II – Availability

    Fulfillment of all orders on PROF shop online is subject to availability.


    We try to ensure that all items offered for sale are in stock.

    However we reserve the right not to accept any orders or to cancel confirmed orders for products that are out of stock.


    In such event we will inform you by e-mail and any payments will be refunded.

  • III – Prices and Promotions

    Prices
    Prices for products displayed are in Euros and include VAT. Shipping fee could also be added to the total price of your order  depending on your address and country of destination. You can learn about  shipping fees in the "Shipping" section.
    PROF reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.
    PROF is not bound to any offer if there are errors or misconceptions in spelling, pricing or otherwise in the information on the site. PROF reserves the right to cancel any sale made under such errors.

    Promotions
    Site offers are valid only for the time they are displayed, unless otherwise stated on the site.

  • V - Exchanges and Returns

    If, for any reason, you are not satisfied with the products you have ordered, you may return them within 100 calendar days from the date of receipt provided that

    - The products have not been worn or washed. With the exception of underwear, the products may only be tried on for size and fit, but may not be worn - The products retain their original characteristics, including packaging and any additional items such as labels - The products are complete with all their elements (e.g. the two parts of a pair of shoes, boxes and labels and any other items in the shipping box or product) - The original packaging is intact.

    - Men's, women's or children's underwear can only be returned if the packaging is still closed and sealed. If the packaging or the seal has been opened and/or tampered with, products will not be accepted for return - Women's underwear can be returned if the hygiene label is still attached 

  • V - Responsibility

    Prof shall only be liable for damages suffered by you in the event such damages result from attributable breach by Prof of its contractual obligations towards you, or in the event Prof liability follows from applicable statutory law.

(PROF) recognises the importance of protecting your personal data, whatever its nature, and values honesty and transparency above all else so that it is possible to build a solid and lasting relationship with clients based on trust and mutual benefit. Therefore, with the entry into force of the European Union's new General Data Protection Regulation (EU 2016/679), we have developed a set of security measures aimed at protecting your data and we have also updated our Privacy Policy.

    The purpose of this Privacy Policy is to explain to you Santos & Júniores, S.A.'s personal data processing policy. If you wish to make a purchase from our online shop, you will have to accept our privacy policy as it is essential and imperative for the delivery of our products.

    2. Our Principles

    2.1 Respect for the client's wishes

    We respect the privacy and security of your personal data, so we endeavour to respect the customer's wishes and their autonomous, free and uncomplicated management of their privacy preferences.     Santos & Juniores S.A. as the personal data controller determines the purposes and means by which your personal data is processed including all applicable security measures. We guarantee that your personal data is processed in Portugal in a correct and lawful manner and in accordance with good practice.

    2.3 Strict necessity

    When processing data that can identify you personally, directly or indirectly, we apply the principle of strict necessity and legitimate interest. For this reason, the use of your personal data will always be kept to a minimum so as not to exceed the original purpose for which it was collected and/or processed.

    3. Collection and Processing of Personal Data

    3.1 The personal data collected and processed by Santos & Júniores, S.A. is only that which you expressly and unequivocally volunteer on the forms on this website.

    3.2 The personal data collected is: name, gender, date of birth, email, mobile phone, address, VAT number.

    4. Purpose of Personal Data Processing

    4.1. Your personal data is collected and processed by Santos & Júniores, S.A. only for purposes strictly related to the use of this website, the services associated with it, the sale of products, the implementation and management of the Loyalty Programme, the sending of direct marketing messages by email and/or SMS and customer support management.

    4.2. PROF always endeavours to maintain the relationship with its customers and provide them with the appropriate benefits, information and relevant content related to our brand. Your data will only be processed for these specific, explicit and legitimate purposes and will not be further processed in any way incompatible with them. The data collected and processed is adequate, relevant and not excessive in relation to these purposes.

    4.3 However, your personal data may also be used for other processing operations within the limits of such applications. In particular, your personal data may be processed for the following purposes:

    a) when you make a purchase on this site, we collect your personal data (e.g. e-mail address, delivery address, credit card number and telephone number) on the purchase form, solely for the purposes of selling, sorting and transporting the products ordered by you;

    b) when you request assistance from Customer Support, we collect your personal data (e.g. first and last name, e-mail address) solely for the purpose of providing you with Customer Support services from the profonlinestore.com online shop that are relevant to this site and to offer you the assistance you have requested;

    c) when you register, we collect your personal data in order to simplify the preparation of your future orders;

    d) when you register or subscribe to the newsletter, we collect your email address in order to send you direct marketing and information messages of interest to you;

    e) when you register or place an order, we collect your mobile phone number in order to send you direct marketing messages and information messages of interest to you and about your orders;

Depending on your management of Cookies on our site and your interaction with us, we use some of the information collected by Cookies to ensure the proper functioning of the site, highlighting the proper display of content, remembering your basket, remembering your registration, adjusting the resolution of your screen, to improve our offers, among others.     g) when you browse our website and subsequently visit platforms where there is an advertising format (social networks, google and other partners of these networks) you may be impacted by adverts from our brand. We will also use the data to reach new potential customers who may be interested in our products.

    4.4 When we collect data, we indicate the mandatory fields with asterisks when the data in question is necessary for:

    Enter into our contract with you (e.g. for the supply of products you have purchased on our websites / apps); Provide you with the service you have requested (e.g. by providing you with a newsletter and informative or direct marketing messages); or Comply with legal requirements (e.g. invoicing). 4.5. Your personal data may be communicated to Santos & Júniores, S.A. service providers for the purpose of providing services, and to judicial, tax and regulatory authorities for the purpose of complying with legal requirements.

    5. Who processes your Personal Data

    5.1 For organisational purposes and in order to be able to offer you the best possible service, Santos & Júniores, S.A. works together with some entities outside its organisation that will process the personal data of the users of this site. This data sharing is strictly for the performance of the services provided by Santos & Júniores, S.A., including the sale of products.

    5.2 These external entities include carriers, technology and digital service providers, digital marketing platforms, among others (edit).The external entities mentioned above have been chosen by Santos & Júniores, S.A. due to their experience in data processing, guarantees of compliance with applicable laws and regulations, as well as the technical security measures adopted by them in relation to the processing of personal data.

    5.3 These external entities will always act in accordance with the instructions provided by Santos & Júniores, S.A. and only for the purposes strictly necessary to their function. Your personal data will be shared with these entities for the purpose of:

    - providing electronic payment services via credit/debit cards;

    - processing product sales;

    - packaging and transporting products;

    - solving problems related to the sale of products;

    - receiving payments for the purchase of products;

    - processing customer product returns;

    - processing and sending direct marketing emails and/or SMS messages;

    5.4 In addition to the above, your data may be shared with third parties in order to:

    Respect for the client's wishes is one of PROF's main concerns when it comes to processing their personal data. However, we do not want to affect the relationship we have with you or fall short of your expectations. We therefore consider that if you have maintained a relationship with us over the last 2 years, i.e. if you have made a purchase, it is not necessary to ask for consent. However, if you disagree, you can object at any time by writing to us at prof@prof.pt.

    7. Your rights

    7.1 To exercise your right to access, rectify, erase, forget or block your personal data, you can send a written communication to the following e-mail address: prof@prof.pt or by letter to Santos & Júniores, S.A., Rua Manuel Dias nº 782, 4495-129 Amorim. You can also do this by contacting any PROF shop or in your customer area in the online shop at www.profonlinestore.com.

    7.2 If you no longer wish to receive direct marketing communications, you can exercise your right to object to the processing of your personal data at any time by managing the consents available in your online shop Customer Area. You can also do this by going to any PROF.

    8. Security

    8.1 PROF uses appropriate security measures to protect your personal data against accidental or unlawful destruction, accidental loss, alteration, dissemination or unauthorised access, and against any other form of unlawful processing. In addition, we contractually require trusted external organisations that process your personal data for us to do the same.

    8.2 However, PROF cannot guarantee that the security measures adopted for the protection of this site and for the transmission of data and information through this site will prevent or exclude any risk of unauthorised access or loss of data. We therefore advise that your computer be equipped with software devices that protect you when transmitting and receiving data (such as up-to-date antivirus systems), and that your browser take appropriate measures to ensure security when transmitting data (such as firewall and anti-spam filters).

    9. Retention and Processing Period

    9.1 Your data will be kept by PROF for the purposes described here for as long as is necessary for the aforementioned purposes, unless the personal data in question is necessary to prove the fulfilment of obligations, until the limitation period for the corresponding rights has elapsed, or if there is a longer data retention period imposed by law.

    9.2 When your personal data is no longer necessary, it will be removed from our systems and records or kept anonymised so that you cannot be identified from it.

  • VII - Loyalty Program - We Are PROF

    The We Are PROF Loyalty Programme is the property of Santos & Júniores, S.A., Rua Manuel Dias nº 782, 4495-129 Amorim - Póvoa de Varzim, hereinafter referred to as "PROF".

    If you have any further questions, you can contact us at any PROF shop or via the customer service contacts prof@profonlinestore.com and 252 298 085 available on working days from 9am to 1pm.

    A) Scope

    A1. The We Are PROF Loyalty Programme rewards customers for purchases made in PROF shops and at www.profonlinestore.com.

    A2. Joining the loyalty programme is free of charge and enables the accumulation of benefits for purchases made, as well as access to offers, exclusive promotions and the receipt of emails from PROF's marketing newsletter and SMS. Membership takes the form of a registered customer account.

    A3. By creating a registered customer account in the online shop or in a physical shop, you expressly accept the Terms and Conditions and the Privacy Policy.

    A4. All Customers with a registered Customer account in the online shop www.profonlinestore.com will automatically benefit from the loyalty programme from the first purchase made after the start of the loyalty programme (15/3/2023), with only purchases made from that date counting towards the loyalty programme.

    A5. Each purchase made, registered in the customer account, will generate a benefit in euros that can be used as a discount on future purchases. For more details on these benefits, please see "Benefits".

    A6. It is the Customer's responsibility, at the time of each purchase, and before payment is made and the invoice issued, to indicate, proactively or on request, an identifying element associated with their customer account (mobile phone number or email address) so that they have access to all the benefits of the loyalty programme.

    A7. It is only possible to associate a purchase and its value with a Customer account when the purchase has been made and paid for.

    A8. PROF reserves the right to cancel, replace or change the loyalty programme without prior notice.

    A9. PROF reserves the right to exclude any Customer from the loyalty programme whenever it detects misuse of the programme.


    B) Benefit

    B1. The benefit is generated on all paid and non-cancelled orders placed in all PROF shops.

    B2. The benefit generated on a purchase can be used on new purchases from the day after the date of the respective invoice.

    B3. The benefits generated are valid for 180 days if not used or if there is no purchase within that period. Every time a purchase is made, the validity of the available balance of the benefit is extended for a further 180 days. If the customer does not make a purchase during 180 days, they will lose their benefit balance.

    B4. You can use the benefit as a discount on purchases whenever your benefit balance/value is equal to or greater than €10.

    B5. Calculation of the benefit:

    The benefit generated when purchasing products with a discount, sale or promotion is lower than the benefit generated when purchasing products without any discount, as follows.

    Benefit generated when buying products without a discount: for every 1 euro in purchases, 0.05 euros are generated. The benefit is calculated based on the final amount of the invoice (the amount actually paid by the Customer), rounded down to the nearest whole number. Example 1: Purchase of: 120.5€ ; Benefit generated: 120€ x 0.05€ = 6€. Example 2: Purchase of 140€ in which the Customer will use 13€ of loyalty balance. The amount payable will be €140 - €13 = €127; Benefit generated: €127 x €0.05 = €6.35. Benefit generated when purchasing products with a discount, sale or promotion: €0.025 is generated for every 1 euro purchased. The benefit is calculated on the basis of the final invoice value (the amount actually paid by the Customer), rounded down to the nearest whole number.

    B6. PROF reserves the right to change the valuation of benefits without prior notice.

    B7. The benefit and the respective balance are not convertible into cash and can only be used for purchases in PROF physical shops or in the PROF online shop.

    B8. Whenever a purchase is cancelled or returned, the points generated with that purchase will be subtracted from the Customer's benefit balance. Whenever the Customer's benefit balance is less than the points they have to return, the difference will be deducted from the refund to be made. Likewise, any benefits consumed with the same purchase will be refunded to the Customer.

    C) Access to information

    C1. The Customer has free access to all information regarding all benefits generated and consumed/used. The Customer can consult this information in all PROF shops and in the customer area of the online shop at www.profonlinestore.com.

    C2. In order to access this information online, the Customer who registers in a physical shop must subsequently complete their online registration.

    C3. Whenever the Customer's benefits balance changes, they will receive an SMS (text message) on the mobile phone number they entered when registering. After creating the registration you will receive an automatic email with a link to complete the registration.

    C4. You can also request this information from a member of staff at a PROF Store or from the customer support contacts available at profonlinestore.com.
